The death of a person in Police custody violates the basic rights of the citizens recognized by the Constitution of India. Typically, it is difficult to secure evidence against the police responsible for adopting third-degree methods since they are in charge of the police station records.
Laws penalising the offence of custodial death in India
Section 302 of the Indian Penal Code (IPC): If a police officer is liable for the death of a suspect in the course of custody, he or she will be charged with murder and would be punished under Section 302 of the IPC.
The Mysterious death of a Youth named Sunil Kumar S/o Diwan chand R/o Village Ghari which falls under Jourian Subdivision Akhnoor left many questions unanswered once again.
The Youth was taken in into police custody on Thursday evening around 5pm by the incharge chowki officer Jourian.
The Youth was brought to Police Chowki Jourian in compliance to the court order for execution of warrant against him on thursday evening as revealed by SDPO Akhnoor while interacting with System Observer.
In morning he was seen not responding well and was shifted to jourian hospital,Where he died
Magistrial Probe ordered he added while briefing System Observer The Police Chkwki Jourian is under CCTV Surveillance.
A total of 175 custodial deaths were reported in India during the year 2021-22(17 Custodial deaths in JKUT)
Almost 70% of deaths in police custody in the past decade (out of a total of 1,004) have been attributed to illness, suicide or death from natural causes which seems to be malicious & invites through investigation.
